I don't think that is quite an inconsistency. The toolbar button with the heart on it is the symbol for the favourites tree. The folder with the star on it is for the root of "favorite items". The root-folder does not toggle the favourite tree panel. The two icons symbolize different functions.
However, I don't really see a reason why "Favourite Items" as a root folder should show in the Favourites Panel at all. I mean, you can't add any other root folders in that panel. Maybe it should just be hidden or removed.

yeah, you are right I don't see a reason either in having a top level folder if there can only be one.Maybe it should just be hidden or removed.
maybe Marek can get rid of it and exchange the heart with a star as beeing standard in Windows:
